Terms of Service

1. Service Description

EmilIA is a marketing analytics platform that connects to third-party advertising and analytics services (including Google Analytics, Google Ads, Meta Ads, Shopify, and others) on your behalf to aggregate data, generate reports, and provide AI-powered insights for e-commerce performance monitoring.

2. Account and Access

• You must be authorized by an existing account holder or receive an invitation to access EmilIA.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must provide accurate and complete information when connecting third-party platforms.

3. Acceptable Use

You agree not to:

• Use EmilIA for any purpose that violates applicable laws or regulations.
• Attempt to gain unauthorized access to other users' data or accounts.
• Reverse engineer, decompile, or attempt to extract the source code of EmilIA.
• Use EmilIA to collect or store personal data beyond what is necessary for analytics purposes.
• Resell, sublicense, or redistribute access to EmilIA without our written consent.

4. Third-Party Platform Access

• EmilIA accesses third-party platforms using OAuth tokens that you authorize. We request read-only access wherever possible.
• You are responsible for ensuring you have the right to connect and share data from the third-party accounts you link.
• We are not responsible for changes to third-party APIs, data availability, or access policies that may affect the service.

5. Data Ownership

• You retain ownership of all data synced from your connected platforms.
• We do not claim any ownership rights over your data. We use it solely to provide and improve the service.
• Reports, insights, and aggregated analytics generated by EmilIA are provided for your use and may be shared at your discretion.

6. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy. By using EmilIA, you consent to the data practices described therein.

7. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
• We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Milimetrix SpA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of EmilIA. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

9. Termination

• You may stop using EmilIA and disconnect your platforms at any time.
• We may suspend or terminate your access if you violate these Terms or if required by law.
• Upon termination, your synced data will be retained for up to 30 days and then permanently deleted, as described in our Privacy Policy.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the application or email. Continued use of EmilIA after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Chile. Any disputes arising from these Terms shall be resolved in the courts of Santiago, Chile.
